Foreclosure Mediation

La Oficina de Juicios Administrativos (OAH) es una agencia estatal independiente que provee un Juez de Leyes Administrativas (ALJ) para escuchar casos en los que una de las partes no esta de acuerdo con la acción de otra agencia estatal. Además de escuchar casos, todos los jueces administrativos son mediadores certificados que regularmente realizan mediaciones en muchos casos.

Las nuevas leyes de Mediación de Ejecuciones Hipotecarias de Maryland que aplican a las ejecuciones hipotecarias que fueren presentadas en la corte el 1 de Junio del 2010 o después, ofrecen a los dueños de casa que están enfrentando una ejecución hipotecaria, la oportunidad de reunirse con el prestamista y un ALJ para lograr encontrar una alternativa a la ejecución hipotecaria.

Una vez que el propietario presenta una solicitud de mediación con el Tribunal de Circuito y paga la cuota de $50.00, el Tribunal de Circuito referirá la solicitud a OAH. OAH llevara acabo la mediación dentro de 60 días después de que reciba la solicitud del Tribunal de Circuito. OAH les enviará a las partes una Notificación de Mediación que les informará la fecha, la hora, y el lugar de la mediación y los documentos requeridos que deben de ser presentados ha mas tardar 20 días antes de la mediación.

Si el prestatario no se presenta a la mediación, el ALJ mandara el caso de vuelta a el Tribunal de Circuito y la venta de la ejecución hipotecaria procedería. Si esto pasa, el prestatario tiene 15 días después de la medición programada para presentar una moción para parar la venta de la ejecución hipotecaria con el Tribunal de Circuito.

Si el prestador no aparece para la mediación programada, el ALJ mandara el caso devuelta a el Tribunal de Circuito el mismo día y el Tribunal de Circuito puede dar acción a la ejecución hipotecaria.

Postponement Request

A party may request a postponement for good cause. Requests must be in writing and received at OAH no later than 5 business days before the mediation. Include the case name and number, the original date of the mediation, the reason for the request, and any documentation that you have to show why you need a postponement.

Also include 3 dates within the next 30 days when you would be available for a rescheduled mediation and a telephone number where you can be reached Monday through Friday between 8:30 a.m. and 4:30 p.m.
